Regulation (EC) No 561/2006: for optimal road safety and improved well-being of private drivers

Providing good working conditions for drivers and fair trading conditions for road transport companies has become a priority in order to ensure a safe and socially responsible transport sector. With this in mind, the European Commission has decided to introduce Regulation (EC) No. 561/2006, which covers requirements for minimum daily and weekly driving times and the duration of rest periods and breaks for all parties involved in the transport of passengers or goods, in France or elsewhere in the EU, over long or short distances. This regulation applies to hauliers and drivers, whether employees or self-employed, as well as employers.

Presentation of Regulation (EC) No. 561/2006

Adopted on March 15, 2006 by the European Parliament and the Council, the Regulation (EC) No. 561/2006 is an essential reference in the sector of truck transport. It mainly applies to vehicles over 3,5 tonnes carrying out the transport of goods and coaches or buses with more than 9 seats used for the transport of passengers, whether they circulate within the territory of a single Member State or between several countries of the European Union. Its main objective is to guarantee fair working conditions for drivers while strengthening the road safety and ensuring fair competition between transport companies.

This text was introduced to respond to concrete problems: driver fatigue, risks of accidents due to excessive driving times, disparities between national regulations and the need for harmonization within the EU. By setting precise rules on driving time, breaks and rest, it helps to protect not only drivers, but also other road users.

Regulation 561/2006 is closely linked to other European texts, particularly those relating to digital tachograph which automatically records the driver's activities. It is also linked to the European social regulation which regulates working conditions in the sector. Together, these measures provide a solid regulatory basis for efficiently organizing road transport, reducing abuses and promoting better journey planning.

Authorized driving times

Work in road transport has virtually no beginning or end. Drivers start at midnight on Monday and finish at midnight on Sunday. This is why the European Parliament decided to strengthen regulations surrounding driving and rest periods for people working in the sector with the implementation of Regulation (EC) No. 00/00.

One of the most important points developed in this text concerns driving times. Each day, driving time is limited to 9 hoursIt is possible to extend it to 10 hours, but only twice a week maximum. Per week, the driving time is set at 56 hoursPlease note, it is imperative not to exceed 90 hours over two weeks.

Break and rest times

The European text also imposes rules concerning drivers' break and rest timesAfter 4 hours of driving, they must take a break of at least 45 minutes and this, without interruption. However, splitting these breaks is possible. Instead of taking 45 minutes straight, the driver can take a 15-minute break and then a 30-minute break, provided that this order is carefully followed. These breaks must be taken during the driving period or immediately after.

What's more, daily and weekly rest periods have also been established. The duration is at least 11 consecutive hours per 24-hour periodIt is possible to split the rest into two: one period of 3 hours in a row and another of 9 hours in a row.

Concerning weekly rest time, it must be at least 45 consecutive hoursOver two weeks, the driver must take two regular rest periods of 45 hours each week or one regular rest period per week of 45 hours and a reduced rest period of at least 24 hours per week.

Regulation (EC) No 561/2006 protects the driver and passengers.

Role of the tachograph and controls

Le digital tachograph is at the heart of the application of Regulation (EC) No. 561/2006. Mandatory for all road goods transport vehicles of more than 3,5 tonnes and for vehicles used for the transport of more than nine persons, It continuously records driving times, rest periods and speedsEach driver has a personal card, which makes the records tamper-proof and allows the driver's activities to be accurately traced.

Inspections are carried out at two levels: on the road, by law enforcement, and in companies, where authorities check stored data. Inspectors can request downloads of tachograph records and driver cards to detect possible fraud or driving time violations. These checks are essential to ensure that hauliers comply with European regulations.

If you have a Failure to comply with the rules can result in severe penalties : high fines, vehicle immobilization, or even suspension of the company's operating license. Drivers can also be sanctioned individually.

What impact does this have on passengers in VTC or van rentals with a private driver?

Regulation (EC) No 561/2006 has positive impacts for the passengers of VTC and vans with driver, especially during long-distance journeys or private excursions. As this text harmonizes driving, break and rest times for drivers throughout the European Union, it thus guarantees a high level of safety and comfort for customers. In concrete terms, it requires drivers to limit their driving hours and incorporate regular breaks, which reduces the risk of driver fatigue and improves the quality of service.

For passengers, this translates to a more peaceful travel experience : journeys are better planned, break times are professionally integrated and vehicles remain compliant with European standards. This regulatory framework also applies to high-end transport companies specializing in group transport which must equip themselves with tachographs and internal procedures for monitoring timetables.
